Todd Spitzer<br />Third District Supervisor<br />Orange County, CA<br /><br />Shane Silsby,<br />Director, Public Works<br />Orange County, CA<br /><br />Dear Supervisor Spitzer and Director Silsby:<br /><br />Attached please see photos of large oak trees along Santiago Canyon Road on the Saddlecrest project site that were razed in recent weeks. Mature cacti that are prime habitat for the threatened cactus wren are also being bisected by roads and destroyed. This is of course the worst possible time to be doing earth-moving, during the best nesting and flowering season in years.<br /><br /><br />The trees were healthy, spring-blooming coast live oaks, exactly the kind needed to sustain heritage populations at a time when drought followed by heavy rains, borers and other stressors are wiping out trees across California en masse.<br /><br /><br />Yet the oak razing and other destruction appear to be perfectly legal in Orange County, thanks to inexplicable foot-dragging by county officials. Staff say it would take $100,000 in consulting fees and a year to 18 months to do anything on a tree ordinance or other protection. This is inexcusable. We urgently request that you expedite work on the proposed tree ordinance, which has languished for a year. A team of land use law and biology experts developed draft language for Orange County last spring. Friends of Harbors, Beaches and Parks submitted it to county planning staff last June. It was supposed to come before the Board of Supervisors last December. That was scrapped. Supposedly some funding may be allocated in July but there is zero sense of urgency.<br /><br />It should not take another year or more to finalize an ordinance and/or implement other protective measures. Orange County is not breaking new ground here - we are woefully behind. Most other communities, the University of California and others promptly adopted or expanded tree protection programs to combat pests and to preserve trees that remain. At a minimum, developer-friendly jurisdictions require special, publicly noticed permits for the possible removal and transplantation of large native trees.<br /><br />Here? Current law allows the SaddleCrest developers and others to replace mature trees with acorns. To phrase it politely, this policy is cause for astonished disbelief among prominent tree experts. We are sure you will agree that preserving the trees that remain in Orange County should be a top priority.<br /><br />In addition, the time is long past to rectify the terrible evisceration of the Foothill Trabuco Specific Plan by a former supervisor who has been out of office for several years and his colleagues. Please act promptly and responsibly to overturn their actions and once again allow reasonable development consistent with the county's rural edge. These areas provide valuable breathing space and recreation for all county residents and the region. Verizon also is planning to install a backup generator and batteries at the Community Center so there will be service during power outages and disasters (the SCC is a designated Red Cross shelter.) These need to be installed on raised platforms, and space and esthetic design is needed for this equipment and platforms.<br /><br />Hopefully by summer all of this will be settled and the roll-out can commence, though that is only a guess at this point. So don't toss out those Network Extender boxes just yet, but be hopeful.<br /><br />Verizon will be installing cell radios on existing electric poles: 6 in Modjeska and 12 along Silverado Canyon Road. CEPA is patterned after the well know CERT format and the content is focused on potential canyon events. You will learn:<ul><li>To make your home, yourself and your family better prepared for emergencies</li><li>Wildland and Structure Fire safety and how to operate a home fire extinguisher</li><li>CPR / AED and basic first aid</li><li>To perform basic home search and rescue operations</li><li>To access the canyon emergency radio system</li><li>To help your community prepare and organize for and deal with larger emergencies.</li></ul><br />Our goal is to reach every resident with this course. &nbsp;<strong><u>Every new resident</u></strong>&nbsp;should attend.&nbsp;&nbsp;If we are all on the same page, the story will have a better ending.<br /><br />Meeting Dates: Sunday evenings 6:30-9PM (all dates are in 2017): January 8, 15, 22, 29, February 12, 26<br />Meeting Place:&nbsp;Modjeska&nbsp;Canyon&nbsp;Fire Station<br />&nbsp;<br />There is a $30 fee for expenses collected at the first session. It was raised briefly at the canyon meeting attended by Todd Spitzer and Colby Cataldi earlier this year and some discussion ensued but the basic issue remains a problem for many.<br />&nbsp;<br />There are many older houses in the canyons, bought in good faith over the last 50 years, and yet not compliant with present codes. If that was the extent of the issue then it would be clear that homeowners need to comply with new codes on any new work/add-ons that they may consider, just like an owner in any other part of the county,<br />&nbsp;<br />However, there are modifications and additions which do not appear on County records. There are many in the canyons who believe that some buildings were permitted and recorded but the records were lost over the years or lost in the fire of which many are aware. There are also buildings that canyon &ldquo;lore&rdquo; would attest to existing in one form or another for 70 plus years but are not in the records either at all or in their present form.<br />&nbsp;<br />This is the cause of much concern, and threatens the equity for which many have committed their life savings, buying homes at full market value many, many years ago but without knowledge of any violation issues, and also the equity of people who have lived here all their lives in very old homes. It hardly seems fair that someone who bought a house at full market value in its present form 30/40/50 years ago, is to be held responsible for errors and omissions of the previous owners.<br />&nbsp;<br />When Colby Cataldi addressed the above-mentioned meeting he said that the county&rsquo;s main concern whenever this situation arises is one of safety. (Colby did say that buildings before 1950 were likely to be dealt with very leniently.)<br />&nbsp;<br />Safety is always important of course, but imposition of modern codes such as &ldquo;arc fault&rdquo; electrical systems, 2013 &ldquo;Green&rdquo; codes and roof foiling, increased foundation depths, while all understandable for new projects, seem very &ldquo;over the top&rdquo; on buildings that are over 40 to 50 years old. We know that buyers should do their due diligence when they buy a home, but 20/30/40 years ago there was less easy access to information (no internet.no email) and less focus on canyon buildings, to the extent that the county did not get much involved.<br />&nbsp;<br />Most of Orange County is not as old or as rural as the canyons; many people in the County still don&rsquo;t know they exist. The canyons are a treasure and unique in their seclusion and ambience, and reflect the character of &ldquo;Old Orange County&rdquo;.<br />&nbsp;<br />We believe there should be some clarification on specifically how canyon homes are to be treated when it comes to older buildings and homes that have had modifications made a long time ago but do not appear on county records. Again we understand that the County should have up to date records of buildings as they are, and have a responsibility to oversee safety, but this needs to be done in such a way that it does not impose such obligations on long-time canyon residents that they suffer immense stress and are expected to spend amounts of money that they simply do not have. The Sil-Mod Plan may be interpreted by the Board and must be read in conjunction with the underlying zoning and the uses of land permitted under that zoning. Public Works in support of a standardized memorial sign for a cyclist recently killed by a DUI driver on Santiago Canyon Road. The family of the victim and OCPW had both requested ICL's input. Click the "Read More" line see the letter.</div>  <div>  <!--BLOG_SUMMARY_END--></div>  <div class="paragraph"><em>Text of the Letter:<br /><br />&#8203;The Inter-Canyon League was asked by county officials to comment on a request by the family of a deceased bicyclist killed in a tragic accident to have a memorial sign honoring him erected along Santiago Canyon Road, which they believe could help save other lives.<br /><br />The ICL does not have jurisdiction over this decision, but we appreciate that the county and the family have taken time to solicit input from the canyon community. We encourage others who wish to comment to county officials to do so as well. We surveyed ICL members and the community, and a majority favor supporting this request as a fitting tribute, with conditions. We would also like to inform county officials that a vocal segment of respondents are adamantly opposed to this sign or any additional signage on this back country road.<br /><br />The ICL board endorses the request if it complies with county sign regulations for this scenic corridor as well as state regulations, and if it is sited in the following stretch: heading south from Orange toward Mission Viejo past the informal signs at the corner of Jamboree Road and Santiago Canyon Road, up to the entrance to the 241 and 261 toll roads. This is the &ldquo;gateway&rdquo; to the back country area and an appropriate location. But it should be noted that the transfer was made to O.C. Parks, a county public agency.&nbsp;We received a few comments that the facility was a fire risk. However, when we asked, Bruce Newell said that he "wouldn't be concerned" about that issue.<br /><br />Most of the survey respondents who answered that it should be closed said the facility was an "eyesore," a "visual blight," and "totally inappropriate." Dan points out the location is still identified that way on USGS maps. They are focusing on five sections in the proposed RMP.<br /><br />As many of you know, OCTA's purchase with Measure M/M2 funds and their subsequent closure of these properties has been a hotly debated topic for more than a year. OCTA's mandate for resource conservation and mitigation intersecting and conflicting with historically open access and connected trails and the desire for recreational hiking and equestrian uses. A June 2015 meeting garnered an overflow crowd at the large Trabuco fire station hall.<br /><br />ETI encourages all canyon equestrians to submit their personal comments directly to OCTA. Comments will be accepted until Feb. 8th, 2016. But ETI would also like to have your comments incorporated in their letter, and they need them by Jan. 13th for inclusion in the final draft.
