Modjeska Creek Clean-Out: Online Application

ICL has obtained a notification leter from the state Department of Fish and Wildlife ("DFW") that allows Modjeska Canyon homeowners to legally remove certain debris from the creekbed on their property.
THIS IS ONLY FOR MODJESKA CANYON PROPERTIES
There is a separate post on the blog below for Silverado Canyon.

There is an online application below. After you fill that out, sign and submit it electronically here, you'll be contacted and a hardcopy packet with all the documents will be sent to you.
The documents can be reviewed below, but are not downloadable here.

    To participate in the Inter-Canyon League's Modjeska El Nino preparation project, you must agree to comply with the rules established by the California Department of Fish and Wildlife.
    • You must be acting as an Inter-Canyon League volunteer. This is true even if you are the homeowner.
    • You must read and comply with the DFW Notification, the Notification Letter, and the Protective Measures. They can be read below, and hardcopies will be in your packet.
    • You must keep a copy of DFW document packet available at your worksite.

    Here are the most important restrictions. This is just a summary. CAREFULLY READ THE DFW NOTIFICATION, especially section 10, before starting work.
    • This ONLY allows you to remove dead trees and non-native vegetation in and near your streambed, and remove deposited sediment in certain areas.
    • You may only use hand-carried tools, including chainsaws.
    • No heavy equipment can be used.
    • Stumps must protrude at least one foot above the ground.
    • You may not make any modifications to the stream, stream flow, or streambed.
    • You must carry out all debris.
    • You may not touch, disturb, or harm any wildlife or habitat you find in the work area.
    • You are working in an endangered species habitat: the Arroyo Toad, and you must use precautions.
    • You must keep a copy of your document packet available for inspection at the worksite.
    Also be aware that:
    • All work must be completed by Febuary 13th, 2016.
    • Section 15 allows DFW to come on-site to inspect your jobsite. Joanne Hubble is available to assist you if you are visited by a DFW site inspector. Her phone number is 714-307-4806.

    ​​To be a participant and volunteer with this project, you MUST agree to follow these rules and instructions.  
    If you are not able to print the documents from an email attachment we will send you, please note that fact in these comments, and a hardcopy packet will be mailed to you. This will take additional time.
    ​In consideration for being permitted by the Inter-Canyon League to participate in the above activities, I hereby waive, release and discharge any and all claims for damages for personal injury, death, or property damage that I may have, or that may hereafter accrue to me as a result of participation in said activities. This release is intended to discharge in advance the Inter-Canyon League and its officers, employees and agents from any and all liability arising out of or connected in any way with my participation in said activity, even though that liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above. It is understood that the activities above involve an element of risk and danger of accidents, and knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold the above persons or entities free and harmless from any loss, liability, damage, cost or expense which they may incur as the result of my death or any injury or property damage that I may sustain while participating in said Inter-Canyon League activities.

    I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE INTER-CANYON LEAGUE AND MYSELF AND I SIGN IT OF MY OWN FREE WILL.
